Business & Website Operator Details (ECTA Section 43(1) Disclosures)

1. General

1.1 When accessing the website at www.10zeros.co.za (the “Website”), you enter into a legally binding agreement with 10 Zeros (Pty) Ltd on the terms set out in this document (the “Terms”).

1.2 These Terms apply to everyone who accesses the Website, whether to view information, submit orders, submit content, inquiries, or as a search engine aggregator (“you” or “your”).

1.3 These Terms, together with the other policies posted on the Website (including our Privacy Policy and Refund Policy), represent the whole agreement between you and us regarding your use of the Website.

1.4 These Terms are governed exclusively by the laws of the Republic of South Africa.

2. Plain Language & The Consumer Protection Act (CPA)

2.1 These Terms are written in plain and understandable language as required by Section 22 of the Consumer Protection Act 68 of 2008 (“CPA”), to the extent the CPA applies to you.

2.2 To comply with the CPA, certain provisions in these Terms are highlighted in bold. These are provisions that:

• Limit or exclude our liability or the risk we take on;
• Place a risk or liability on you;
• Require you to indemnify us or another person; or
• Are an acknowledgement of a fact by you.

3. Acceptance of These Terms

3.1 By accessing or using the Website, you agree to be bound by these Terms. If you do not agree to any part of them, you must immediately cease using the Website.

3.2 Where the Website asks you to accept these Terms by clicking a button or ticking a checkbox, you agree that this constitutes your electronic signature with full legal effect as contemplated in Sections 11, 13, and 22 of the Electronic Communications and Transactions Act 25 of 2002 (“ECTA”).

10. Suspension and Termination

10.1 We may suspend or terminate your account or access to the Website at our sole discretion if we reasonably believe you have violated these Terms or applicable laws.

11. Disclaimer of Warranties

11.1 You use this Website at your sole risk. The Website and its contents are provided on an “as is” and “as available” basis without express or implied warranties of any kind, to the fullest extent permitted by South African law.

12. Limitation of Liability

12.1 To the fullest extent permitted by law, 10 Zeros (Pty) Ltd will not be liable for any indirect, incidental, special, or consequential damages resulting from your use of, or inability to use, the Website.

12.2 Nothing in these Terms excludes or limits liability where prohibited by law, including mandatory protections under the Consumer Protection Act (CPA).

13. Legal Capacity

13.1 You confirm that you are at least 18 years of age (or have explicit parental/guardian consent) and possess full legal capacity to enter into binding agreements.

14. General Provisions

14.1 Severability: If any provision is deemed unenforceable, the remaining provisions will continue in full force.

15. Online Sales, Cooling-Off Period & Secure Payment (ECTA Compliance)

15.1 Order Review (ECTA s 43(2)): Before placing an order, our checkout system provides a full summary allowing you to review order items, correct errors, or withdraw from the purchase.

15.2 Transparent Pricing (ECTA s 43(1)(i)): Total prices including applicable VAT, delivery charges, and fees are displayed prior to payment confirmation.

15.3 Statutory Cooling-Off Right (ECTA s 44): Natural person consumers are entitled to cancel transactions without penalty within seven (7) days of receiving goods, subject only to direct return shipping costs.

15.4 Exceptions to Cooling-Off (ECTA s 42(2)): The 7-day cooling-off right does not apply to custom-fabricated metal ducting, bespoke furniture/couches made to specific customer dimensions, unsealed software, or emergency repair services already rendered.

15.5 Delivery Guarantee (ECTA s 46): Orders are fulfilled within 30 days unless a custom fabrication timeline is agreed upon in writing.
